ORDER CONCLUDING SETTLEMENT PROCEEDINGS AND DISMISSING APPEAL

On August September 14, 2026, the settlement judge filed a report indicating that the parties were unable to agree to a settlement. See NRAP 16. Accordingly, settlement proceedings are concluded.

On August 4, 2026, this court issued a notice referring this matter to the settlement program and informing appellant that the docketing statement must be filed within 21 days. See NRAP 14(b). Appellant was cautioned that failure to comply could result in the imposition of sanctions, including dismissal of this appeal. See NRAP 14(c). Because the docketing statement had not yet been filed, on August 27, 2026, this court entered an order directing appellant's counsel to file the docketing statement within 7 days, cautioning that failure to comply would result in the imposition of sanctions, including dismissal of this appeal. To date the docketing statement has not been filed. Accordingly, this appeal is dismissed.
