ORDER DENYING PETITION FOR WRIT OF MANDAMUS OR PROHIBITION
This emergency petition for a writ of mandamus or prohibition challenges a March 2, 2026, guardianship order assuming jurisdiction over the protected person's trust, removing petitioner Andrea Bowers and real party in interest Lenora Hausey as co-trustees, and confirming the Clark County Public Guardian as temporary successor trustee for purposes of selling the real and nonessential personal property in the trust. The order also authorizes the successor trustee to list the real property for sale. Petitioners have filed an emergency motion for stay.
Having considered the petition and supporting documents, we are not persuaded that this matter is appropriate for writ relief. Pan v. Eighth Jud. Dist. Ct., 120 Nev. 222, 228, 88 P.3d 840, 844 (2004) (explaining that petitioners bear the burden of demonstrating that extraordinary relief is warranted); Smith v. Eighth Jud. Dist. Ct., 107 Nev. 674, 677, 818 P.2d 849, 851 (1991) (providing that this court has sole discretion in determining if a writ petition will be considered). In particular, writ relief is not available when a plain, speedy, and adequate legal remedy exists, and such a remedy exists here in the form of an appeal from the March 2 order. See NRS 34.170; NRS 159.375(4), (9); NRS 155.190(f), (h); NRS 164.005; Pan, 120 Nev. at 223, 88 P.3d at 841. Accordingly, our review of the order by way of writ petition is precluded, and the petition is denied. The emergency stay motion, which was filed after hours on the same day relief was requested, is denied as moot.
