ORDER REFERRING ATTORNEY TO SOUTHERN NEVADA DISCIPLINARY BOARD

This is a petition under SCR 111(4) concerning attorney Jonathan E. MacArthur, based on a conviction of one count of misdemeanor battery under NRS 200.481.¹

Because the conviction is not a “serious crime” as defined in SCR 111(6), temporary suspension and referral for disciplinary proceedings are not mandatory. SCR 111(7), (8). Having considered the petition and supporting documentation, we conclude that the conviction does not warrant a temporary suspension given that the criminal conduct occurred nearly two years ago and MacArthur's sentence included conditions to safeguard against reoccurrence. SCR 111(9). But considering the nature of the offense, we refer this matter to the Southern Nevada Disciplinary Board. Id.

It is so ORDERED.²
