FLAMINGO PARADISE GAMING, LLC, Petitioner, v. The EIGHTH JUDICIAL DISTRICT COURT of the State of Nevada, IN AND FOR the COUNTY OF CLARK and the Honorable Veronica Barisich, District Judge, Respondents, and Julian Valentino, Real Party in Interest.
ORDER GRANTING PETITION
This is an original petition for a writ of mandamus or prohibition challenging a district court order affirming the discovery commissioner's recommendation. In Powers v. Eighth Jud. Dist. Ct., 142 Nev., Adv. Op. 35, 589 P.3d 638, 642 (2026), we held that to the extent NRS 629.620 conflicts with NRCP 35, the statute is unconstitutional. Powers directly addresses some of the issues presented by the petition in this case. Rather than address those issues in the first instance, we grant the petition, vacate the district court's discovery order in this case, and direct the district court to resolve this matter consistent with Powers. Accordingly, we
ORDER the petition GRANTED AND DIRECT THE CLERK OF THIS COURT TO ISSUE A WRIT OF MANDAMUS instructing the district court to vacate its November 15, 2024, order and to resolve this discovery dispute consistent with Powers.
