FERNANDO ROBLES, Appellant, v. THE STATE OF NEVADA, Respondent.
ORDER DISMISSING APPEAL
This appeal was initiated by the filing of a pro se notice of appeal challenging “the denial of the district court of motion to correct illegal sentence, on the 5 date of 5 2026.” Eighth Judicial District Court, Clark County; Joseph Hardy, Jr., Judge.
Appellant's notice of appeal fails to identify any appealable decisions of the district court. See NRAP 3(c)(1)(B). No decision was entered in the underlying district court case on May 5, 2026. To the extent appellant is appealing the September 29, 2025, district court order denying motion for reconsideration of motion to correct illegal sentence, the order is not appealable, as no statute or court rule permits an appeal from it, and the appeal is untimely. Accordingly, this court lacks jurisdiction to consider this appeal. Castillo v. State, 106 Nev. 349, 352, 792 P.2d 1133, 1135 (1990) (explaining that this court has jurisdiction only when statute or court rule provides for appeal); Phelps v. State, 111 Nev. 1021, 1022-23, 900 P.2d 344, 344-45 (1995) (an order denying a motion for reconsideration is not appealable in a criminal matter); NRAP 4(b); Lozada v. State, 110 Nev. 349, 352, 871 P.2d 944, 946 (1994) (explaining that an untimely notice of appeal fails to vest jurisdiction in this court). Accordingly, this court
ORDERS this appeal DISMISSED.
