ORDER DISMISSING PETITION FOR WRIT OF MANDAMUS
This emergency petition for a writ of mandamus challenges an April 10, 2023, district court order excluding Cellebrite cell phone data evidence
On April 17, 2023, we entered an order directing an answer and expedited preparation of the transcripts, while also deferring ruling on an emergency stay motion because it appeared that the district court had continued the trial. Later the same day, petitioner filed a notice of withdrawal of emergency petition for writ of mandamus. In the notice, petitioner explains that the district court continued trial until June, such that emergency relief is no longer needed, and expressly moves to voluntarily dismiss the petition.
Petitioner's motion is granted, NRAP 42(b), and this writ proceeding is dismissed. We thus vacate the directives set forth in our April 17 order directing answer and deny petitioner's stay motion as moot.
