EDDIE RAY BOZARTH, Petitioner, v. THE HONORABLE GARY FAIRMAN, DISTRICT JUDGE; THE HONORABLE STEVE L. DOBRESCU, DISTRICT JUDGE; AND THE SEVENTH JUDICIAL DISTRICT COURT OF THE STATE OF NEVADA, IN AND FOR THE COUNTY OF LINCOLN, Respondents,
THE STATE OF NEVADA, Real Party in Interest. EDDIE RAY BOZARTH, Petitioner, v. THE SEVENTH JUDICIAL DISTRICT COURT OF THE STATE OF NEVADA, IN AND FOR THE COUNTY OF LINCOLN, Respondent, THE STATE OF NEVADA, Real Party in Interest.
ORDER DENYING PETITIONS
These are consolidated original pro se petitions seeking to disqualify the judges of the Seventh Judicial District Court for cause and bias and for a writ of mandamus.1
Although petitioner references a criminal matter and provided affidavits in support of his allegations, he has not provided this court with any record, exhibits, or documents in support of his claims and necessary for this court's consideration of the petitions. See NRAP 21(a)(4) (providing that petitioner shall submit an appendix containing all documents “essential to understand[ing] the matters set forth in the petition”).
Petitioner bears the burden of showing that extraordinary relief is warranted. See Pan v. Eighth Judicial Dist. Court, 120 Nev. 222, 228, 88 P.3d 840, 844 (2004). We conclude that petitioner has failed to demonstrate our intervention by extraordinary writ is warranted. To the extent that petitioner has counsel, he must proceed by and through counsel of record. We further note that it does not appear that petitioner served respondents or real party in interest with notice of his petitions. See NRAP 25(d)(1), (3). Therefore, we decline to exercise our original jurisdiction in this matter. See NRAP 21(b). Accordingly, we
ORDER the petitions DENIED.
Stiglich, C.J.
Cadish, J.
Herndon, J.
