ORDER APPROVING CONDITIONAL ADMISSION AGREEMENT
This is an automatic review of a Southern Nevada Disciplinary Board hearing panel's recommendation that this court approve, pursuant to SCR 113, a conditional admission agreement in exchange for a stated form of discipline for attorney Madeline L. DiCicco. Under the agreement, DiCicco admitted to violating RPC 8.4(b) (misconduct—criminal act) and SCR 111 (attorneys convicted of crimes). DiCicco agreed to an eighteen-month suspension, of which twelve months are stayed for three years pending compliance with conditions. This court temporarily suspended DiCicco on June 25, 2025.
DiCicco admitted she was convicted of reckless driving resulting in substantial bodily harm in 2024. DiCicco also admitted to convictions for DUI – 1st Offense in 2005, DUI – 2nd Offense in 2007, and DUI – 2nd Offense (reduced from felony DUI after completing Felony DUI Treatment Court) in 2013. DiCicco did not report any of these convictions to bar counsel. See SCR 111.
The issue for this court is whether the agreed-upon discipline sufficiently protects the public, the courts, and the legal profession. See In re Discipline of Arabia, 137 Nev. 568, 571, 495 P.3d 1103, 1109 (2021) (stating the purpose of attorney discipline). In determining the appropriate discipline, we weigh four factors: “the duty violated, the lawyer's mental state, the potential or actual injury caused by the lawyer's misconduct, and the existence of aggravating or mitigating factors.” In re Discipline of Lerner, 124 Nev. 1232, 1246, 197 P.3d 1067, 1077 (2008); see also SCR 102.5(1).
DiCicco admitted to knowingly violating a duty owed to the public (failure to maintain personal integrity). DiCicco further admitted the conduct caused injury to the integrity of the profession and the public. The baseline sanction for such violations, before considering the aggravating and mitigating circumstances, is suspension. See Standards for Imposing Lawyer Sanctions, Compendium of Professional Responsibility Rules and Standards, Standard 5.12 (Am. Bar Ass'n 2023) (providing that suspension is appropriate “when a lawyer knowingly engages in criminal conduct ․ that seriously adversely reflects on the lawyer's fitness to practice”). The record supports no aggravating circumstances and two mitigating circumstances (full and free disclosure to disciplinary authority and cooperative attitude toward the proceeding, acceptance of responsibility). Considering all four factors, we conclude that the agreed-upon discipline is appropriate.
Accordingly, we hereby suspend attorney Madeline L. DiCicco from the practice of law in Nevada for eighteen months, of which twelve months are stayed for three years pending compliance with the conditions outlined in the conditional admission agreement. The suspension shall run from the date of DiCicco's temporary suspension on June 25, 2025. The conditions include requirements that DiCicco receive no discipline for conduct engaged in during the stay period: abide by the conditions set forth in Eighth Judicial District Court Case No. C-24-383667-1; submit to an evaluation with the Nevada Lawyer Assistance Program (NLAP) and follow the recommendations of the NLAP provider; and report monthly to the Office of Bar Counsel. DiCicco shall also pay the cost of the disciplinary proceedings, including $2,500 under SCR 120, within 60 days from the date of this order. The State Bar shall comply with SCR 121.1.
