ORDER DISMISSING APPEAL
Review of the documents before this court reveals a jurisdictional defect. This court has jurisdiction to consider an appeal only when the appeal is authorized by statute or court rule. Taylor Constr. Co. v. Hilton Hotels Corp., 100 Nev. 207, 678 P.2d 1152 (1984). No statute or court rule provides for an appeal from an order striking a motion to dismiss.
Further, a final judgment is one that finally resolves all claim and issues against all parties to an action and leaves nothing to the district court's consideration except post-judgment issues. Lee v. GNLV Corp., 116 Nev. 424, 426, 996 P.2d 416, 417 (2000). There can be only one final judgment in a case. Alper v. Posin, 77 Nev. 328, 363 P.2d 502 (1961), overruled on other grounds by Lee, 116 Nev. at 426, 996 P.2d at 417. Although appellants claim that the challenged order is independently appealable under NRAP 3A(b)(1), appellants also concede that declaratory relief claims and default proceedings remain pending below. Because no appeal lies from a district court order striking a motion to dismiss, and it appears that there has been no final judgment or disposition in the case below, we lack jurisdiction over this appeal. NRAP 3A(b)(1). Accordingly, we
ORDER this appeal DISMISSED.
