PACIFIC WEST LLC, A NEVADA LIMITED-LIABILITY COMPANY, Appellant, v. JOSEPH A. MAGLIARDITI, INDIVIDUALLY, Respondent.
ORDER VACATING JUDGMENT AND REMANDING
This is an appeal from a district court order granting attorney fees and costs following dismissal of an action. Eighth Judicial District Court, Clark County; Timothy C. Williams, Judge.
The district court dismissed appellant Pacific West, LLC (PW)’s claims against respondent Joseph A. Magliarditi. PW appealed that decision in Pacific West, LLC v. Magliarditi, Docket No. 88933. The district court then granted Magliarditi's motion for attorney fees and costs, and awarded Magliarditi $1,167,050.67 in attorney fees and $148,293.90 in costs.
We have now affirmed in part and reversed in part the district court's order dismissing the claims against Magliarditi in Docket No. 88933. Accordingly, it is no longer clear whether Magliarditi could recover attorney fees and costs. We therefore vacate the attorney fees and costs award and remand for the district court to consider, in the first instance, whether Magliarditi is entitled to attorney fees in light of our remand in Docket No. 88933. See LVMPD v. Blackjack Bonding, 131 Nev. 80, 90, 343 P.3d 608, 615 (2015) (holding that a party need not succeed on every issue to be a prevailing party and that instead, “[a] party prevails if it succeeds on any significant issue in litigation which achieves some of the benefit it sought in bringing suit” (citation modified)). Accordingly, we
ORDER the judgment of the district court VACATED AND REMAND this matter to the district court for proceedings consistent with this order.
