ORDER WAIVING FILING FEE AND DISMISSING APPEAL

This is an appeal from a district court order affirming an appeal from a justice court summary eviction. Eighth Judicial District Court, Clark County; Jennifer L. Schwartz, Judge.

Appellant has filed a copy of a justice court order granting his application to proceed in forma pauperis. Accordingly, the filing fee for this appeal is waived. See generally, NRAP 24(a)(2); NRS 12.015(2).

Our review of this appeal reveals a jurisdictional defect. Specifically, appellant's case arose in justice court. The district court has final appellate jurisdiction over cases arising in the justice court. Nev. Const. art. 6, § 6; Waugh v. Casazza, 85 Nev. 520, 521, 458 P.2d 359, 360 (1969). Accordingly, we conclude we lack jurisdiction to consider this appeal and we

ORDER this appeal DISMISSED.¹
