MARVIN JOSE MIRANDA, Appellant, v. THE STATE OF NEVADA, Respondent.
ORDER DISMISSING APPEAL
This is an appeal initiated by the filing of a pro se notice of appeal. Second Judicial District Court, Washoe County; Kathleen M. Drakulich, Judge.
Appellant filed the notice of appeal on February 27, 2026, stating that he appeals “the Findings of Fact, Conclusions of Law and Order denying/dismissing Petition for Writ of Habeas Corpus, which was filed/entered on the 24 day of Feb., 2026.” This court's review of this appeal reveals a jurisdictional defect. Specifically, no oral ruling or written order was entered on or around the date that appellant specified in his notice of appeal, and no order to which the notice of appeal could apply appears on the docket. See Castillo v. State, 106 Nev. 349, 352, 792 P.2d 1133, 1135 (1990) (explaining that this court has jurisdiction only when statute or court rule provides for appeal); NRAP 3(c)(1)(B). To the extent, if any, appellant's notice of appeal can be construed as challenging the July 16, 2025, judgment of conviction, the notice of appeal is untimely. See NRAP 4(b); Lozada v. State, 110 Nev. 349, 352, 871 P.2d 944, 946 (1994) (explaining that an untimely notice of appeal fails to vest jurisdiction in this court). Accordingly, this court lacks jurisdiction and
ORDERS this appeal DISMISSED.
