ORDER DISMISSING APPEAL
This is an appeal of an order partially granting a motion to dismiss and denying declaratory relief. Eighth Judicial District Court, Clark County; Gloria Sturman, Judge.
Initial review of the docketing statement and documents before this court revealed a potential jurisdictional defect. Specifically, it appeared that the order was not appealable as a final judgment because it failed to resolve all claims against all parties. NRAP 3A(b); Lee v. GNLV Corp., 116 Nev. 424, 426, 996 P.2d 416, 417 (2000) (defining a final judgment). It also appeared that the district court's NRCP 54(b) certification was improper because it does not expressly determine that there is no just reason for delay. See NRCP 54(b); Hern v. Erhardt, 113 Nev. 1330 n.4. 948 P.2d 1195, 197 n.4 (1997) (concluding that a purported certification under NRCP 54(b) was “improper because the district court did not make an express determination that there was no just cause for delay”).
In the response to the order to show cause, appellant concedes that this court has no jurisdiction to consider this appeal of an interlocutory order. Accordingly, we
ORDER this appeal DISMISSED.
