ORDER DISMISSING APPEAL WITHOUT PREJUDICE
This pro se appeal challenges a district court summary judgment in a quiet title action. Eighth Judicial District Court, Clark County; Kathleen E. Delaney, Judge.
Based on the documents before this court, we lack jurisdiction over this appeal. Specifically, no final judgment has been entered because claims remain pending as to codefendant Jennifer Fontes. The district court's order granting summary judgment challenged in this appeal only resolved the claims against appellant Kelly Fontes and, as a result, was not a final judgment. Lee v. GNLV Corp., 116 Nev. 424, 996 P.2d 416 (2000) (stating a final judgment is one that resolves all claims as to all parties). Nor was the order certified as final under NRCP 54(b). Because the district court has not yet resolved the claims against Jennifer, jurisdiction remains in the district court and Kelly's appeal is premature. NRAP 4(a)(6). Thus, we lack jurisdiction to consider Kelly's appeal at this time. See Taylor Constr. Co. v. Hilton Hotels Corp., 100 Nev. 207, 209, 678 P.2d 1152, 1153 (1984) (noting that this court generally has authority to consider an appeal only when authorized by statute or court rule). Accordingly, we dismiss this appeal without prejudice to Kelly's right to appeal upon entry of a final judgment.
