IN RE: the ESTATE OF Charles Fisher BROWN, Deceased. Marilee Brown and Marilou Brown, Appellants, v. Gregory Brown, Respondent
ORDER DISMISSING APPEAL
Initial review of the documents before this court reveals a jurisdictional defect. Specifically, with the exception of the July 8, 2025, district court order challenged by appellants in Docket No. 91111, neither the district court's January 6, 2026, order confirming the recommendation to stay proceedings nor the January 21, 2026, order denying appellants’ motion to dismiss are substantively appealable under NRAP 3A(b) or the statute authorizing appeals from certain probate orders, NRS 155.190. See Brown v. MHC Stagecoach, LLC, 129 Nev. 343, 345, 301 P.3d 850, 851 (2013) (this court “may only consider appeals authorized by statute or court rule”). As no statute or court rule allows for an appeal of the order staying the probate proceedings or denying appellants’ motion to dismiss, and appellants have already challenged the July 8, 2025, order in Docket No. 91111, the court lacks jurisdiction and
ORDERS this appeal DISMISSED.1
FOOTNOTES
1. Appellants’ motion filed February 19, 2026, is denied as moot. The clerk shall strike the docketing statement filed on March 2, 2026.
