IN RE: DISCIPLINE OF Amy N. FOWLER, Bar No. 12371.
ORDER IMPOSING RECIPROCAL DISCIPLINE
This is a petition under SCR 114 for reciprocal discipline of attorney Amy N. Fowler based on discipline imposed in Utah. From the petition, it does not appear that Fowler self-reported the Utah discipline to the Nevada State Bar as required by SCR 114(1). Fowler has not responded to this petition. See SCR 114(3) (allowing but not requiring a response).
According to the Utah district court order imposing discipline, Fowler violated a Utah rule of professional conduct equivalent to Nevada's RPC 8.4(d) (conduct prejudicial to the administration of justice). In imposing a stayed one-year suspension with probation conditions, the Utah order referenced Fowler's Unsworn Declaration of Consent and a Stipulated Discipline by Consent and Settlement Agreement between Fowler and the Utah Office of Professional Conduct.
Under SCR 114(4), this court must impose identical reciprocal discipline unless the attorney demonstrates, or this court determines, that any of four exceptions apply. Those exceptions are: (1) the other jurisdiction failed to provide adequate notice, (2) “there was such an infirmity of proof establishing the misconduct” in the other jurisdiction that this court could not accept the decision of that jurisdiction, (3) the established misconduct warrants sufficiently different discipline in this jurisdiction, and (4) the established misconduct does not constitute misconduct under Nevada's professional conduct rules. SCR 114(4).
None of the exceptions apply, so we grant the petition for reciprocal discipline. Accordingly, we hereby suspend attorney Amy N. Fowler for one year from the date of this order, with the suspension stayed subject to a one-year probation. Fowler's probation is subject to the conditions set forth in the Utah discipline order. The Nevada State Bar shall comply with SCR 121.1.
