John Carl COLLETTI, Appellant, v. The STATE of Nevada, Respondent.
ORDER DISMISSING APPEAL
Because no statute or court rule permits an appeal from an order denying such postconviction motions in a criminal matter, this court lacks jurisdiction to consider this appeal from that order. Castillo v. State, 106 Nev. 349, 352, 792 P.2d 1133, 1135 (1990). In regard to appellant's September 5, 2023, judgment of conviction, the January 23, 2026, notice of appeal is untimely. NRAP 4(b); Lozada v. State, 110 Nev. 349, 352, 871 P.2d 944, 946 (1994) (explaining that an untimely notice of appeal fails to vest jurisdiction in this court). See Colletti v. State, Docket No. 88104 (Order Dismissing Appeal, February 22, 2024) (dismissing untimely appeal from the same judgment of conviction). There is no indication that appellant has applied for and been granted appeal deprivation relief under NRAP 4(c). Accordingly, this court
ORDERS this appeal DISMISSED.
