Christy Kay SWEET, Petitioner, v. The EIGHTH JUDICIAL DISTRICT COURT of the State of Nevada, IN AND FOR the COUNTY OF CLARK; The Honorable Jessica K. Peterson, District Judge; The Honorable Gloria Sturman, District Judge; and James Fontano, District Court Commissioner of Probate, Respondents, Kathryn Sweet; Vanessa Johnson; Christopher Hisgen; and Marilyn Weeks Sweet, Real Parties in Interest.
ORDER DENYING PETITION
This pro se original petition for a writ of mandamus challenges district court orders declaring petitioner a vexatious litigant. The decision to entertain a petition for extraordinary writ relief lies within the discretion of this court. Smith v. Eighth Jud. Dist. Ct., 107 Nev. 674. 677, 679, 818 P.2d 849, 851, 853 (1991) (recognizing that writ relief is an extraordinary remedy and that this court has sole discretion in determining whether to entertain a writ petition).
Having considered the petition, we conclude that our intervention is not warranted given the substantial time elapsed since issuance of the challenged orders and petitioner's failure to provide a persuasive reason for her delay in seeking writ relief. See Pan v. Eighth Jud. Dist. Ct., 120 Nev. 222, 224, 88 P.3d 840, 841 (2004). Accordingly, we
ORDER the petition DENIED.1
FOOTNOTES
1. Petitioner's notice and fee waiver is construed as a motion to waive the filing fee and is granted. NRCP 21(g).
