IN RE: THE RESIGNATION OF CURTIS CANNON, BAR NO. 10535.
ORDER GRANTING APPLICATION FOR RESIGNATION
This is a joint application by the State Bar of Nevada and attorney Curtis Cannon for Cannon's resignation from the Nevada bar. SCR 93(5) provides that Nevada attorneys who are not actively practicing law in this state may resign from the State Bar if certain conditions are met. The application acknowledges that disciplinary charges remain pending against Cannon for alleged violations of RPC 1.4(a) (communication), RPC 1.5(a) (fees), RPC 1.3 (diligence), RPC 1.8(j) (conflict of interest), RPC 1.15(d) (safekeeping property), RPC 1.16(d) (declining or terminating representation), RPC 3.2(a) (expediting litigation), and RPC 8.4 (misconduct).
Despite the pending disciplinary charges, bar counsel has recommended that the resignation be approved. SCR 93(5)(b) allows resignation by members with pending disciplinary charges after consideration of bar counsel's recommendation. Cannon has not practiced law since 2012. The pending disciplinary charges against Cannon are for conduct that predate Cannon's 2012 arrest and later conviction on a gross misdemeanor criminal charge. Cannon has agreed to sign a civil confession of judgment to the client security fund based on a fee dispute in the pending disciplinary charge and for the remaining costs of the bar proceedings. Cannon has also agreed to never reapply for admission. Cannon acknowledges that this resignation is irrevocable and that the State Bar retains continuing jurisdiction with respect to matters involving a past member's conduct prior to resignation. See SCR 93(5)(c)-(d). The State Bar in turn acknowledges it does not presently possess any new facts or grievances on which it could premise a future disciplinary action against Cannon.
Having considered the application and bar counsel's recommendation, we conclude the petition satisfies the requirements of SCR 93(5). Accordingly, we approve attorney Curtis Cannon's resignation and hereby grant the application. SCR 93(5)(b).
