ORDER DISMISSING APPEAL
This is an appeal from a district court order denying a motion to reconsider an order granting respondent's motion for summary judgment. Eighth Judicial District Court, Clark County; Susan Johnson, Judge.
Initial review of the notice of appeal revealed a potential jurisdictional defect. Specifically, it appeared the challenged district court order is not a substantively appealable under NRAP 3A(b)(2) because the district court had not yet addressed the issue of damages requested by respondent such that no final judgment has been entered below. Accordingly, this court issued an order to show cause as to why this appeal should not be dismissed for lack of jurisdiction.
Appellant filed a response and respondent filed a reply. Appellant's response completely fails to address the issue of damages or otherwise demonstrate the appealability of the challenged order. Instead, appellant recounts the irrelevant procedural history of respondent's motion(s) for attorney fees and costs and, without argument, asserts that this appeal “should be allowed to proceed.”
“[T]he burden rests squarely upon the shoulders of a party seeking to invoke our jurisdiction to establish, to our satisfaction, that this court does in fact have jurisdiction.” Moran v. Bonneville Square Assocs., 117 Nev. 525, 527, 25 P.3d 898, 899 (2001). Here, appellant has neither demonstrated this court's jurisdiction under NRAP 3A(b)(2), nor has appellant identified any other rule or statute that would allow jurisdiction in this appeal. This court lacks jurisdiction and
ORDERS this appeal DISMISSED.
