IN RE: DISCIPLINE OF MATTHEW W. BEASLEY, BAR NO. 9756.
ORDER OF DISBARMENT
More than three years ago, this court temporarily suspended attorney Matthew Beasley under SCR 102(4)(b) pending the resolution of formal disciplinary proceedings. That suspension was based on allegations that, among other things, Beasley had orchestrated and/or engaged in a Ponzi scheme to defraud investors of millions of dollars and had used his trust account to facilitate the scheme. In re Discipline of Beasley, No. 84445 (Nev. Apr. 1, 2022) (Order Granting Petition for Temporary Suspension and Restricting Handling of Client Funds).
Now, the Southern Nevada Disciplinary Board, bar counsel, and Beasley have filed a joint petition for Beasley's disbarment by consent. The petition is supported by Beasley's declaration, stating that he freely and voluntarily consents to disbarment, after having had the opportunity to consult with counsel. Beasley acknowledges in the declaration that the material facts set forth in the petition are true and that he could not successfully defend against pending disciplinary proceedings for violations of RPC 1.15(a) (safekeeping property), RPC 4.1 (truthfulness in statements to others), and RPC 8.4 (a)-(c) (misconduct).
SCR 112 provides that an attorney who is the subject of a disciplinary proceeding involving allegations of misconduct may consent to disbarment by delivering an affidavit to bar counsel. Beasley's declaration meets the requirements of SCR 112(1). See NRS 53.045. Accordingly, we grant the petition. See SCR 112(2) (providing that the petition must be filed with this court and this court “shall enter an order disbarring the attorney on consent”).
Attorney Matthew Beasley is disbarred from the practice of law in Nevada commencing from the date of this order. The parties shall comply with SCR 115 and SCR 121.1.
