IN RE: THE PARENTAL RIGHTS AS TO: P.B.-B., DOB 03/23/2018, A MINOR CHILD. THERESA S., Appellant, v. THE STATE OF NEVADA DEPARTMENT OF HEALTH AND HUMAN SERVICES, DIVISION OF CHILD AND FAMILY SERVICES, AND P.B.-B., A MINOR CHILD, Respondents.
ORDER DISMISSING APPEAL
This is an appeal from a district court stipulation and order indicating that appellant consented to the adoption of the minor at issue and dismissing a petition to terminate appellant's parental rights without prejudice. First Judicial District Court, Carson City; Jason Woodbury, Judge.
Review of the notice of appeal and documents submitted to this court reveals a jurisdictional defect. Specifically, the notice of appeal appears to be untimely filed under NRAP 4(a)(1) and NRAP 26(c) because it was filed more than 30 days after service of the written notice of entry of the order. Notice of entry of the challenged order was served on appellant by mail on June 2, 2025. However, appellant did not file her notice of appeal in the district court until August 15, 2025, well beyond the 30-day appeal period. An untimely notice of appeal fails to vest jurisdiction in this court. See Healy v. Volkswagenwerk Aktiengesellschaft, 103 Nev. 329, 331, 741 P.2d 432, 433 (1987) (this court lacks jurisdiction over an untimely notice of appeal). Further, it does not appear that appellant is aggrieved by the challenged order. See NRAP 3A(a) (only an aggrieved party may appeal); Vinci v. Las Vegas Sands, Inc., 115 Nev. 243, 984 P.2d 750 (1999) (when a party voluntarily stipulates to the entry of an order, that party is not aggrieved and may not later attack the order as adversely affecting that party's rights). Because we lack jurisdiction, we
ORDER this appeal DISMISSED.
