ORDER DISMISSING SUPPLEMENTAL APPEAL
Because the appeal from the June 25, 2025, order denying the pretrial petition for a writ of habeas corpus in Docket No. 91012 had already been dismissed for lack of jurisdiction, as an order denying a pretrial habeas petition cannot be appealed by the defendant, Gary v. Sheriff, 96 Nev. 78, 605 P.2d 212 (1980); Sheriff v. Gillock, 112 Nev. 213, 912 P.2d 274 (1996), the supplemental notice of appeal was docketed as a new case. For the same reasons given in the order dismissing the appeal in Docket No. 91012, however, we now conclude we lack jurisdiction and dismiss the supplemental appeal.
We note that appellant's counsel has filed a notice of appeal from the June 11, 2025, judgment of conviction in the underlying case, and that appeal is proceeding under Docket No. 90818. It appears that an issue regarding credits for time served has been raised in that direct appeal. Accordingly, regarding the supplemental appeal in this docket from the order denying appellant's pretrial habeas petition, we
ORDER this appeal DISMISSED.
