ORDER OF REFERRAL TO SOUTHERN NEVADA DISCIPLINARY BOARD

Bar counsel has filed a petition pursuant to SCR 111(4) informing this court that on January 8, 2025. attorney Thomas Boley entered a no contest plea in Henderson Municipal Court. Boley was convicted of driving under the influence, a misdemeanor. As required by SCR 111(2). Boley self-reported the conviction, which is his second such conviction, the first occurring roughly nine years earlier. According to the exhibits attached to the petition, bar counsel investigated this matter and presented its findings to a screening panel of the Southern Nevada Disciplinary Board as required by SCR 111(4). The petition includes the screening panel's recommendation regarding the appropriate disciplinary action. See SCR 111(4).

Having reviewed the petition and the supporting documentation, we agree with the screening panel that some discipline may be warranted. But at this early stage, we cannot, agree with the particular discipline recommended by the screening panel. We therefore exercise our discretion to refer this matter to the Southern Nevada Disciplinary Board “for any action it may deem warranted.” SCR 111(9). We decline, however, to impose a temporary suspension. Id.
