ROY D. MORAGA, Appellant, v. C/O GARCIA; C/O MS. FRAZIER AND S C/O HIULEY, Respondents.
ORDER DISMISSING APPEAL
This is a pro se appeal from a district court order dismissing a complaint. Seventh Judicial District Court, White Pine County; Steve L. Dobrescu, Judge.
On April 9, 2025, this court entered an order directing appellant to file and serve an amended motion for waiver of costs and a transcript request form, if deemed warranted, within 14 days. See NRAP 9(a)(2), (9). The order cautioned that failure to timely comply with this order could result in the imposition of sanctions, including the dismissal of this appeal. Appellant attempted to file a motion for waiver of costs and a transcript request form on May 14, 2025; however, the documents were returned to appellant because they were untimely, the court reporter was not listed on the transcript request form, and the motion was not served on respondent. Appellant was directed to refile the motion for waiver of costs and the transcript request form accompanied by a motion for an extension of time. When appellant failed to file the motion for waiver of costs, a transcript request form, or a motion for extension of time, this court entered an order on June 5, 2025, directing appellant to file and serve the documents within 14 days. The June 5 order also directed appellant to file and serve his overdue opening brief or informal brief within the same time period. The order cautioned appellant that failure to comply could result in the dismissal of this appeal. See NRAP 9(a)(10); NRAP 31(d).
To date, appellant has failed to file the motion for waiver of costs, a transcript request form, or a motion for extension of time, and an opening brief or informal brief. Accordingly, as it appears appellant has abandoned this appeal, this court
ORDERS this appeal DISMISSED.
