ORDER APPROVING DISCIPLINARY PANEL'S RECOMMENDATION AND GRANTING MOTION TO SEAL
The State Bar has filed a petition pursuant to SCR 111(4) informing this court that in May of 2024, attorney Randal Leonard entered into a no contest plea for driving under the influence, a misdemeanor, which was subsequently reduced to a charge of reckless driving, also a misdemeanor. As required by SCR 111(2), Leonard self-reported the resulting conviction, which is his second such conviction, the first occurring approximately four years earlier.
The petition is supported by documentation indicating that, pursuant to SCR 111(4), bar counsel investigated this matter, which was presented to a screening panel of the Southern Nevada Disciplinary Board with a recommendation that Leonard be placed in a diversion program under SCR 105.5 for a period of six months. The screening panel agreed with the recommendation and, Leonard and the State Bar entered into a diversion program consent agreement. The State Bar has also filed a motion to seal the consent agreement, which is attached to the petition as Exhibit 5.1
Having reviewed the petition and the panel's recommendation, we approve the recommendation that Leonard be placed in the diversion program, subject to conditions. SCR 111(4), (9). We also grant the motion to seal the exhibit. SCR 105.5(1)(c); SCR 105.5(2); SCR 121(1). The clerk of the court shall detach the diversion program consent agreement (Exhibit 5) from the petition and file it under seal.
