ORDER DENYING PETITION FOR WRIT OF MANDAMUS
This emergency petition for a writ of mandamus challenges a district court order denying a motion to continue trial. The motion sought a continuance due to concerns regarding counsel's health, and as directed, petitioners filed a supplemental appendix containing a doctor's letter on the matter.
Having reviewed the petition and supporting documents, we are not persuaded that writ relief is appropriate in this matter. Pan v. Eighth Jud. Dist. Ct., 120 Nev. 222, 228, 88 P.3d 840, 844 (2004) (explaining that petitioners bear the burden of demonstrating that extraordinary relief is warranted); Smith v. Eighth Jud. Dist. Ct., 107 Nev. 674, 677, 818 P.2d 849, 851 (1991) (stating that this court has sole discretion in determining if a writ petition will be considered). While we are sympathetic to the health concerns raised in the petition, it does not appear that our intervention is warranted to preclude the district court from proceeding with trial at this time. Accordingly, we
ORDER the petition DENIED.
