ORDER DISMISSING APPEAL
Appellant has filed a notice of dismissal of this appeal in which he states that he did not intend to file the instant appeal and by the time he realized his error, he had already paid this court's $250 filing fee. Appellant asks this court to dismiss this appeal, send it back to the district court, and return his filing fee.
The notice is construed as a motion to voluntarily dismiss this appeal and refund the filing fee. The motion to dismiss is granted. However, because the filing fee is due upon the filing of the notice of appeal, NRAP 3(e), and the purpose of the filing fee is for the docketing of the appeal in this court, the motion to refund the filing fee is denied. Accordingly, we
ORDER this appeal DISMISSED.
