ORDER ADMINISTRATIVELY CLOSING APPEAL AND REGARDING CAPTION
Docket No. 88947 is an appeal and cross-appeal from a district court order finally resolving a breach of contract action, including the associated counterclaims and third-party claims. Docket No. 88953 is an appeal from an interlocutory district court order, entered in the same district court case, resolving a motion for attorney fees and costs.
Upon further review, this court concludes the appeal in Docket No. 88953 was improperly docketed as a new matter. The clerk shall administratively close the appeal in Docket No. 88953 and transfer the documents in that appeal to Docket No. 88947. The clerk shall modify the caption in Docket No. 88947 consistent with the caption on this order.
Appellants/cross-respondents shall have until March 21, 2025, to file and serve the opening brief and appendix in Docket No. 88947. Thereafter, briefing shall proceed in accordance with NRAP 28.1(c). Newport Consulting's challenge to the order resolving the motion for fees and costs may be briefed in its combined answering brief on appeal and opening brief on cross-appeal and the briefs responsive thereto. See id. The failure of any party to timely file briefs in this matter may result in the imposition of sanctions, including the dismissal of the party's appeal. See NRAP 31(d)(1).
