ORDER DISMISSING APPEAL

This is an appeal from a judgment of conviction pursuant to jury trial. Eleventh Judicial District Court, Pershing County; Jim C. Shirley, Judge.

Appellant's counsel has filed a motion to withdraw this appeal on the basis that it is premature and the parties have agreed that the judgment of conviction underlying this appeal will be amended. Cause appearing, the motion is granted, and this appeal is hereby dismissed. See NRAP 4(b)(7); NRAP 42.
