ORDER APPROVING DISCIPLINARY PANEL'S RECOMMENDATION AND GRANTING MOTION TO SEAL
Bar counsel has filed a petition pursuant to SCR 111(4) informing this court that on April 18, 2024, in Las Vegas Township Justice Court, attorney Stephanie Smith entered a no contest plea to an amended charge of reckless driving, a misdemeanor, after having been originally charged with driving under the influence, also a misdemeanor. As required by SCR 111(2), Smith self-reported the resulting conviction, which is her second such conviction, the first occurring roughly nine years earlier. The exhibits attached to the petition support that bar counsel investigated this matter, which was presented to a screening panel of the Southern Nevada Disciplinary Board with a recommendation that Smith be placed in a diversion program pursuant to SCR 105.5 for a period of one year, subject to conditions. The screening panel agreed with the recommendation and, as a result, Smith and bar counsel entered into a diversion program consent agreement. Also, bar counsel has filed a motion to seal the consent agreement, which was attached to the petition as exhibit 6.
Having reviewed the petition and the panel's recommendation, we approve the recommendation that Smith be placed in the diversion program for one year, subject to conditions. SCR 111(4), (9). We also grant the motion to seal the exhibit. SCR 105.5(l)(c); SCR 121(1). The clerk of this court shall file the diversion program consent agreement (Exhibit 6) under seal.
