ORDER DISMISSING APPEAL
When this court's review of the docketing statement and other documents revealed a potential jurisdictional defect, this court ordered appellant to show cause why this appeal should not be dismissed for lack of jurisdiction. Specifically, it appeared that claims remained pending below, including the first, second, fifth, and sixth causes of action, such that the order challenged on appeal is not substantively appealable as a final judgment. NRAP 3A(b)(1); Lee v. GNLV Corp., 116 Nev. 424, 426, 996 P.2d 416, 417 (2000) (defining a final judgment as one that resolves all of the issues presented in the case, except for post-judgment matters). The show cause order noted that the district court's March 12 order is not certified as final under NRCP 54(b), and no other court rule or statute appears to allow for the appeal.
Appellant filed a timely response to the show cause order demonstrating that the district court has granted reconsideration of the March 12 order and reinstated the third, fourth, and seventh causes of action. Appellant acknowledges that, due to the reinstatement of the claims, the appeal is moot and appellant is unable to demonstrate this court's jurisdiction. Accordingly, we
ORDER this appeal DISMISSED.
