ORDER DISMISSING APPEAL
This is an appeal from a district court order denying a motion to relocate and a motion to produce child at hearing. Second Judicial District Court, Family Division, Washoe County; Bridget E. Robb, Judge.
When initial review of the docketing statement and documents before this court revealed a potential jurisdictional defect, this court ordered appellant to show cause why this appeal should not be dismissed for lack of jurisdiction. In particular, it appeared that the notice of appeal was prematurely filed in the district court after the timely filing of a tolling motion seeking reconsideration of the challenged order, but before entry of a written order resolving that motion. See NRAP 4(a)(4); NRAP 4(a)(6); AA Primo Builders LLC v. Washington, 126 Nev. 578. 585, 245 P.3d 1190, 1195 (2010).
Appellant did not timely file a response or otherwise communicate with this court. Accordingly, on June 21, 2024, this court entered an order directing appellant to show cause, by June 28, 2024, why this appeal should not be dismissed for lack of jurisdiction. This court cautioned that failure to demonstrate that this court has jurisdiction could result in the dismissal of this appeal. To date, appellant has not filed a response or otherwise communicated with this court.
Appellant fails to demonstrate that this court has jurisdiction. See Moran v. Bonneville Square Assocs., 117 Nev. 525, 527, 25 P.3d 898, 899 (2001) (“[T]he burden rests squarely upon the shoulders of a party seeking to invoke our jurisdiction to establish, to our satisfaction, that this court does in fact have jurisdiction.”). ORDER this appeal DISMISSED.
