ORDER DENYING EMERGENCY WRIT PETITION

This emergency petition for a writ of mandamus seeks a writ directing the district court to vacate its March 28, 2024, protective order restricting petitioner from reporting on a redacted police investigative report relating to the criminal investigation of Dennis Carry.

Mandamus is properly requested to compel the district court to perform a legally required act or to correct a manifest abuse or arbitrary or capricious exercise of discretion. NRS 34,160; State v. Eighth Jud. Dist. Ct. (Armstrong), 127 Nev. 927, 931, 267 P.3d 777, 779 (2011). Whether a petition seeking such extraordinary relief will be considered by this court, however, is purely discretionary. Smith v. Eighth Jud. Dist. Ct., 107 Nev. 674, 677, 818 P.2d 849, 851-52 (1991). Having considered the petition and the appendix, we conclude that petitioner has not demonstrated that our intervention by extraordinary writ relief is warranted. See Pan v. Eighth Jud. Dist. Ct., 120 Nev. 222, 228, 88 P.3d 840, 844 (2004).

Petitioner filed the instant writ petition this morning and seeks relief by the end of today. While we acknowledge that petitioner filed the writ as soon as practicable, this court has insufficient time to meaningfully review and address the issues raised by petitioner within the timeframe requested. We also decline, on this record, to retain this matter for review under the mootness exception petitioner identifies. Accordingly, we decline to exercise our discretion to intervene by way of extraordinary writ relief, and we
