ORDER DISMISSING APPEAL

This is a pro se appeal from an order for dismissal and remand to a lower court. Eighth Judicial District Court, Clark County; Michelle Leavitt, Judge.

This court's review of this appeal reveals a jurisdictional defect. Specifically, appellant's case arose in the municipal court. The district court has final appellate jurisdiction over a case arising in the municipal court. Nev. Const. art. 6, § 6; Tripp v. City of Sparks, 92 Nev. 362, 363, 550 P.2d 419, 419 (1976). Additionally, even if the order could be appealed to this court, appellant filed the notice of appeal from the August 8, 2023, order for dismissal and remand to lower court on October 13, 2023, well after the expiration of the 30-day appeal period prescribed by NRAP 4(b). Lozada v. State, 110 Nev. 349, 352, 871 P.2d 944, 946 (1994) (explaining that an untimely notice of appeal fails to vest jurisdiction in this court). Accordingly, this court lacks jurisdiction and

ORDERS this appeal DISMISSED.
