JOSEPH LOUIS FERNANDEZ, Appellant, v. THE STATE OF NEVADA, Respondent.
ORDER DISMISSING APPEAL
Appellant has filed a pro se notice of appeal. Eighth Judicial District Court, Clark County; Michelle Leavitt, Judge.
This court's review of the notice reveals a jurisdictional defect. Appellant fails to identify any appealable order in his notice of appeal. To the extent, if any, the notice of appeal can be construed as challenging the March 2, 2023, judgment of conviction, the instant October 10, 2023, notice of appeal is untimely. NRAP 4(b)(1)(a). Nor does it appear that appellant has followed the procedure for an untimely appeal set forth in NRAP 4(c)(1). Appellant's notice of appeal indicates that he would like to file a petition for a writ of habeas corpus seeking post-conviction relief. Any such petition must be filed in the district court in the first instance. See NRAP 22. Accordingly, this court lacks jurisdiction and
ORDERS this appeal DISMISSED.
