ORDER DISMISSING APPEAL

This is a pro se appeal from a purported district court decision denying appellant's petition for factual innocence. Eighth Judicial District Court, Clark County; Mary Kay Holthus, Judge.

Appellant filed a notice of appeal on September 5, 2023, and it was docketed in this court on September 7, 2023. The notice of appeal refers to a petition for factual innocence in district court docket C-245467, Dept. No. 23, but no such petition is listed in the docket entries for that case. See NRAP 3(c)(1)(B). Further, it does not appear from the district court docket and minute entries that the district court has entered any other order to which the notice of appeal could apply. Castillo v. State, 106 Nev. 349, 792 P.2d 1133 (1990) (explaining that this court has jurisdiction only when statute or court rule provides for appeal). Accordingly, this court

ORDERS this appeal DISMISSED.
