IN RE: THE PARENTAL RIGHTS AS TO: C. C. G.; C. C. C. AND E. C. C., MINORS. MELISSA ANN C., Appellant, v. CLARK COUNTY DEPARTMENT OF FAMILY SERVICES; C. C. G.; C. C. C.; AND E. C. C., MINORS, Respondents.
ORDER DISMISSING APPEAL
This is an appeal from a district court order terminating parental rights. Eighth Judicial District Court, Clark County; Cynthia N. Giuliani, Judge.
On May 17, 2023, the clerk of this court issued a notice directing appellant, among other things, to file and serve the docketing statement by June 7, 2023, and to file and serve the opening brief or informal brief by August 15, 2023. The notice cautioned that failure to timely file the opening brief or informal brief could result in the dismissal of this appeal. See NRAP 31(d).
Appellant did not timely file the docketing statement. Accordingly, on June 26, 2023, this court entered an order directing appellant to file and serve the docketing statement by July 10, 2023. This court cautioned that failure to timely comply could result in the imposition of sanctions, including the dismissal of this appeal. NRAP 14(c). Appellant did not comply or otherwise communicate with this court.
On July 11, 2023, the June 26, 2023, order mailed to appellant by this court was returned to this court by the United States Postal Service as undeliverable. Although this court remailed the order to appellant, it was again returned as undeliverable.
On July 18, 2023, respondent Clark County Department of Family Services filed a motion to dismiss this appeal based on appellant's failure to timely file the docketing statement. To date, appellant has not opposed the motion. In addition, appellant has failed to file the docketing statement and opening brief or informal brief, or otherwise communicate with this court. Under these circumstances, it appears appellant has abandoned this appeal and this court
