RICARDO FOJAS, AS SUCCESSOR IN INTEREST AND REAL PARTY IN INEREST TO SOLANA RIDGE FAMILY TRUST, Appellant, v. US BANK NATIONAL ASSOCIATION, A LENDER DOING BUSINESS IN NEVADA Respondent.
ORDER DISMISSING APPEAL
This is a pro se appeal from a district court order entered in a proceeding pertaining to the title of real property. Eighth Judicial District Court, Clark County; Mary Kay Holthus, Judge.
Review of the notice of appeal and documents before this court reveals a jurisdictional defect. NRAP 3A(a) allows only an aggrieved party to appeal. A person or entity is a “party within the meaning of NRAP 3A(a) ․ [if] that person or entity has been served with process, appeared in the court below and has been named as a party of record in the trial court[.]” Valley Bank of Nev. v. Ginsburg, 11.0 Nev. 440, 447, 874 P.2d 729, 734 (1994). It does not appear that appellant was served with the underlying complaint or named as a party in the proceedings below. While it appears appellant. Ricardo Fojas. filed a motion to substitute himself as a “successor in interest” to the Solana Ridge Family Trust, it does not appear the district court entered an order resolving this motion. As Mr. Fojas was not served, named as a party, or added as a successor in interest pursuant to Mr. Fojas's motion, Mr. Fojas is not a party within the meaning of NRAP 3A(a). Mr. Fojas, therefore, lacks standing to appeal. This court lacks jurisdiction and
ORDERS this appeal DISMISSED.
