LBSW v. S.K., Respondent and Appellant (2026)

AFFIRMED.

[¶1] S.K. appeals the district court's order committing her to treatment at Sanford Health or the North Dakota State Hospital for up to ninety days. S.K. argues the court erred in finding by clear and convincing evidence S.K. is mentally ill and a person requiring treatment, and no less restrictive treatment was appropriate.

[¶2] This Court's review of an appeal from a mental health treatment order is limited to a review of the procedures, findings, and conclusions of the district court. Int. of Doe, 2019 ND 23, ¶ 4, 921 N.W.2d 403. We review the findings of the court under the more probing clearly erroneous standard of review. Id. “A finding of fact is clearly erroneous if it is induced by an erroneous view of the law, there is no evidence to support it, or if on the entire evidence we are left with a definite and firm conviction a mistake has been made.” Int. of M.R.M.-B., 2026 ND 82, ¶ 33, 34 N.W.3d 128 (quoting Goetz v. Goetz, 2026 ND 53, ¶ 6, 32 N.W.3d 354).

[¶3] The district court's findings are supported by clear and convincing evidence and are not clearly erroneous. We summarily affirm under N.D.R.App.P. 35.1(a)(2).
