Michael JANUSZEWSKI, Appellant v. NORTH DAKOTA WORKFORCE SAFETY AND INSURANCE, Appellee
[¶1] Michael Januszewski appeals from a district court judgment affirming an administrative law judge's (“ALJ”) order upholding a North Dakota Workforce Safety and Insurance decision denying him workers’ compensation benefits. The ALJ determined Januszewski's claim for benefits was subject to a forfeiture penalty under N.D.C.C. § 65-05-33 because Januszewski willfully made false statements. Januszewski challenges the weight of the evidence supporting the ALJ's willfulness finding and argues WSI failed to prove his statements were material. We conclude the ALJ's findings are supported by a preponderance of the evidence. See N.D.C.C. §§ 28-32-46(5), 28-32-49. We decline to address Januszewski's remaining arguments because he has not provided citations to the record or supporting reasoning and authority. See State v. Haibeck, 2006 ND 100, ¶ 9, 714 N.W.2d 52 (“Our Court will not consider an argument that is not adequately articulated, supported, and briefed.”). We summarily affirm under N.D.R.App.P. 35.1(a)(5).
