STATE of Missouri, Respondent, v. Rex Allen SIZEMORE, Appellant.
ORDER
Rex Sizemore appeals the judgment of the Circuit Court of Adair County convicting him, after a bench trial, of one count of unlawful possession of a firearm under section 571.070, RSMo. Prior to trial, Sizemore filed a motion to dismiss, asserting section 571.070 was unconstitutional as applied to him under the Second and Fourteenth Amendments of the United States Constitution. The trial court denied the motion. We affirm. Because a published opinion would have no precedential value, see State v. Robinson, 707 S.W.3d 60, 67 (Mo. App. W.D. 2025) (finding section 571.070 constitutional as applied to the defendant under the Second and Fourteenth amendments), we have instead provided a memorandum of law to the parties. Rule 30.25(b).
