STATE of Missouri, Respondent, v. Jeffrey Blaine JOST, Appellant.
ORDER
Jeffrey Blaine Jost (“Jost”) appeals the judgment of the Circuit Court of Boone County, Missouri (“trial court”), finding him guilty of one count of assault in the first degree, section 565.050, and sentencing Jost to ten years in the Department of Corrections. On appeal, Jost claims that the trial court abused its discretion in allowing into evidence portions of the audio and video surveillance footage that showed Jost's interactions with other individuals preceding the altercation because they are more prejudicial than probative and constitute improper propensity evidence which caused the jury to convict him of the assault. We affirm the judgment of the trial court. Rule 30.25(b).
