CTOS RENTALS, LLC, d/b/a Custom Truck, Respondent, v. NELSON RESIDENTIAL GROUP, LLC, Appellant.
ORDER
Nelson Residential Group, LLC, appeals the trial court's judgment in favor of CTOS Rentals, LLC, d/b/a Custom Truck. On appeal, Nelson claims the trial court erred in sustaining CTOS's motion for summary judgment because: (1) there remained genuine issues of material fact as to the existence, terms, and breach of a written rental contract between the parties; and (2) CTOS failed to establish that each of Nelson's affirmative defenses failed as a matter of law, in that CTOS did not address Nelson's affirmative defenses in its summary judgment motion. We affirm. Because a published opinion would have no precedential value, we have provided an unpublished memorandum to the parties which sets forth the reasons for this order. Rule 84.16(b).
