STATE of Missouri, Respondent, v. Jessie Lee NELSON, Appellant.
ORDER
After a jury trial in the Circuit Court of Buchanan County, Jessie Nelson was convicted of one count of first-degree murder, one count of first-degree assault, and two counts of armed criminal action. Nelson appeals, alleging two points of error. In his first point, he contends that the trial court plainly erred in failing to sua sponte declare a mistrial after comments made by a venireperson during voir dire. In his second point, he contends that the trial court erred in overruling Nelson's motion to suppress an out-of-court and in-court identification of Nelson, arguing that the identification procedures used were unduly suggestive, resulting in an inherently unreliable identification. Finding no error, we affirm. Because a published opinion would have no precedential value, a memorandum explaining the reasons for our decision has been provided to the parties. Rule 30.25(b).
