Richard AGUILAR, Respondent, v. GEICO CASUALTY COMPANY, Appellant.
ORDER
GEICO Casualty Company (“GEICO”) appeals from the Order of the Circuit Court of Jackson County, Missouri, (“trial court”) granting a motion for new trial filed by plaintiff Richard Aguilar (“Aguilar”) after previously granting GEICO's motion for partial summary judgment and denying Aguilar's motion for partial summary judgment on Aguilar's equitable garnishment claim. On appeal, GEICO claims that the trial court erred in ordering a new trial based on the partial summary judgment not being a final appealable order in that it did not dispose of a distinct judicial unit arguing: (1) such determination relates only to the form of the judgment; and (2) such determination was incorrect. This opinion will address those two claims together. We affirm the order of the trial court, and remand this matter back to the trial court for disposition of Aguilar's claims. Rule 84.16(b).
