Daniel YEE, Personal Representative in the Estate of Thic Lem Toy a/k/a Gong Ging Choi Toy, Appellant, v. Sammy Chill Yim CHOI and Seto Pui Yi Choi, Respondents.
ORDER
Thic Lem Toy died in April 2016. Toy’s will named Daniel Yee as the personal representative of his estate. In January 2017, Yee filed a discovery of assets action pursuant to § 473.340, RSMo. The petition alleged that one of Toy’s three sons, Sammy Choi, exercised undue influence over Toy in August 2005, when Toy changed the terms of a brokerage account to add Choi as a joint tenant with rights of survivorship. The petition also alleged that Choi converted the assets in the brokerage account; that Choi knew or should have known that Toy did not intend to retitle the account; and that Choi was unjustly enriched by the 2005 change in account ownership. The circuit court granted Choi’s motion for summary judgment, finding that Yee’s claims were time-barred. Yee appeals. We affirm. Because a published opinion would have no precedential value, we have provided an unpublished memorandum to the parties which sets forth the reasons for this order. Rule 84.16(b).
