Tori HICKS, Appellant, v. BOARD OF TRUSTEES FOR the FIREFIGHTERS’ PENSION SYSTEM OF the CITY OF KANSAS CITY, MISSOURI TRUST, Respondent.
ORDER
Tori Hicks appeals the judgment of the Jackson County Circuit Court affirming the decision of the Board of Trustees of the Firefighters Pension System of Kansas City, Missouri Trust. On appeal, Hicks argues that he was entitled to disability pension benefits. In his first point on appeal, Hicks argues that the Pension Board erred in not relying on the written opinions of two physicians in makings its determination of disability status. In his second point on appeal, Hicks argues that the Pension Board ignored medical evidence that he is permanently disabled from performing several essential firefighter duties. In his third point on appeal, Hicks argues that the Pension Board erred in basing its determination on the suspicion that Hicks’ symptoms were malingering rather than basing its determination on competent medical evidence establishing Hicks’ corrected visual acuity. Because a published opinion would have no precedential value, a memorandum has been provided to the parties. The judgment is affirmed. Rule 84.16(b).
