STATE of Missouri, Respondent, v. Jay R. PALMER, Appellant.
ORDER
Jay Palmer appeals his convictions for assault in the second degree, felony stealing, and two counts of armed criminal action. In two points on appeal, Palmer challenges the trial court's refusal to submit his proposed instruction on assault in the fourth degree and its denial of his Batson challenge to the State's use of a peremptory strike to remove a venireperson. Because a published opinion would serve no jurisprudential purpose, a memorandum explaining the reasons for the decision is provided to the parties. The judgment is affirmed. Rule 30.25(b).
