MISSOURI EMPLOYERS MUTUAL INSURANCE COMPANY, Appellant, v. METRO HOOD AND DUCT CLEANING LLC, Respondent.
ORDER
Missouri Employers Mutual Insurance Company appeals the summary judgment entered in favor of Metro Hood and Duct Cleaning LLC on Insurance Company's respondeat superior claim in a subrogation action to recover amounts paid in workers’ compensation benefits to N.L. In its sole point on appeal, it contends that genuine issues of material fact exist regarding whether Metro Hood's employee, Charles Henderson III, was acting in the course and scope of his employment at the time he struck and injured N.L. with his motor vehicle. Because a published opinion would have no precedential value, a memorandum explaining the reason for this decision is provided to the parties. The judgment is affirmed. Rule 84.16(b).
